we don't yet know what is going to happen at midnight when the cooling off period expirz. good evening, everyone. >> with that midnight deadline just six hours away there has been no strike called but no agreement reached on a deal to prevent one, either. the two sides are still meeting as we speak in oakland. bart board of directors met this morning and authorized a negotiator to put a new offer on the table. bart says two sides are just $16 million apart. we have live coverage tonight. heather, sounds like real progress, at least, being made. >> yes. the standards are so low that a new overhear can be considered progress. we have no indication that that offer is going to be good enough to avert a strike and get a deal done in time. indications are they're still

millions of dollars part. the chief negotiator, tom hawk came with a new offer, one he calls reasonable, a good offer, compared to other transit agencies. but we have learned that that offer has bt yet been looked at by unions. they're still going over issues separate for each of the two unions. on the positive side, bart has not yet issued a last, best, final offer. unless the current one is a departure from what can come so far, unions are likely to reject this, outright. >> we're preparing to put something out there that gives them something to look at to take back to their membership to vote. >> i don't want to give anyone a false impression we're going to be voting anything or that we're not going on strike. i don't want anyone to get the false impression we are going on strike. it's difficult for us at the table as our members as the riding public. >> now, fdiu today did say

>> one department supposedly deputy searched for the missing woman but missed her. >> if a search is done for a woman and 17 days later her body was found that is not an adequate search. i don't know how standards fell down. but these are not the standards to which a fine institution like san francisco general should expect it's security detail to live up to. >> with understanding they are the police of the site them have jurisdiction on the grounds. that is as much as i can say about that. and i'm not into pointing fingers at this time. >> the sheriff's department tells abc 7 news the mayor's announcement make nose difference in this case. says would it have begun an investigation without him.

>> a san francisco police sargeant has been arrested on drunk driving charges. the sargeant, seen here nine years ago, was off duty driving his personal car when' apparently rear ended another vehicle in the city's sunset district tuesday night. a witness saw the crash and called police. officers follow aid trail of debris to the car parked in front of his home. he was arrested and then, later released. he is a 22 year veteran placed on administrative leave. >> a reported of a gunman on san jose state university campus revealed gaps in security this, morning a student reported a possible gunman wearing black clothes inside sweeney hall. police cordoned off the he building and swept it room by room. 300 staff and students were inside at the time but some students dmot find a safe classroom in which to hide. really scared. >> our classroom is not

breaking news from langs lngs a jury just ruled toyota is not liable for a woman's dmej a sudden acceleration case. the 66-year-old died when her camery crashed into a tree after it sped out of control. her family was seeking $20 million in damages. the jury sided with toyota saying a defect did not contribute, instead blaming the driver of another car that crashed into uno's just before it sped out of control. >> time is up for foster farms.

the government gave the company 72 hours to with a plan to clean up three plants. one contaminated plant is in livingston, two others in fresno. did foster farms meet that deadline? >> we're not sure yet. the agriculture department says changes need to be made in order for the plant to remain open as it is now in the government. it's still reviewing whether those changes are underway. trucks come and go. shift workers stop, and start their day. employees told me they're worried jobs are on the line. government inspectors and investigators watching their every move, making sure the food supply here is safe. this while advocates voice their concerns. >> we would like foster farms to issue a recall for these

raw chicken products associated with skplants would like the u.s. department of agriculture to request that foster farms makes this recall. >> the food safety and inspection service says there is no imminent threat and have not recalled any foster farms products but that said, investigators have asked the company to fix the problem. >> they do have ability to do better control their production process to reduce the amount of contamination on the product producing. >> the agriculture department issued a public health alert this week after 278 people got sick, five of those were here in fresno. investigate investigators linked illnesses to faster farms. >> this operation can operate in a more consistent and optimal way. so with that, and in light of the illnesses that are associated, we're expecting
